Terms of Use

1. Information, not an offer

The site presents homes that are being designed and built. Its content is provided for information and does not constitute an offer, a reservation or a contract. A purchase is made only by a written contract signed with the relevant seller, and that contract governs the home, its specification, price, payment schedule, delivery and warranty.

2. Plans, images and the 3D walkthrough

Floor plans, areas, visualisations, films and the live 3D walkthrough illustrate the current design. They are indicative and subject to final design, planning approvals and construction tolerances. Furniture, landscaping, finishes and views are shown for illustration and may differ from what is delivered unless the contract specifies them.

3. Prices, payment plans and currencies

• Prices are set in US dollars and apply to the current release. Later releases will be priced higher. We may change prices and availability at any time until a contract is signed.
• Payment plans, discounts and schedules shown on the site are illustrative summaries. The applicable plan is the one set out in your contract.
• Amounts shown in currencies other than US dollars are indicative conversions at the rate and date stated. Payments are made at the exchange rate on the payment date.
• No payment can be made through the site.

4. Delivery dates and availability

Delivery dates are estimates. Availability shown on the site is updated regularly but may not reflect reservations made very recently. A home is reserved only when the seller confirms it in writing.

5. Enquiries

When you send a request, you confirm that the information you give is accurate and that you are entitled to give it. A request does not reserve a home or oblige you or us to proceed. We handle your personal data as described in our Privacy Policy.

6. Acceptable use

• Use the site lawfully and only for its intended purpose.
• Do not attempt to gain unauthorised access to the site, its servers or the 3D walkthrough service, or interfere with their operation.
• Do not send automated, bulk or misleading requests, or use the site to send spam.
• Do not copy, scrape or reuse the site's content except as permitted below.

7. Intellectual property

The site and its content—including names, logos, architectural designs, plans, images, films and software—belong to Pernefer Group or its licensors. You may view the site and save or print a buyer brief for your personal use in considering a purchase. Any other use requires our written permission.

8. Liability

We take care to keep the site accurate and available, but we do not guarantee that it will be uninterrupted or free of errors. To the extent permitted by law, we are not liable for loss arising from reliance on the site's content instead of the contract, or from the site being unavailable. Nothing in these terms limits any liability that cannot be limited by law, or your statutory rights as a consumer.

Links to other websites are provided for convenience. We are not responsible for their content or practices.

10. Governing law

Matters relating to Umbral Alto are governed by the laws of Colombia; matters relating to Obsidian Crown are governed by the laws of Georgia. This does not deprive you of the protection of mandatory rules of the country where you live, where those rules apply.
